
The Trump Administration's campaign of mass detention and deportation has swept up thousands of people, subjecting them to inhumane and dangerous conditions of immigration detention. In this case, TIP joined a growing movement of lawyers responding to this constitutional crisis by filing a habeas petition to challenge the Administration's unlawful detention of our client in violation of his right to procedural due process as guaranteed by the Fifth Amendment of the U.S. Constitution.
Mr. Alvarado Carrero is just one of thousands of people who had been re-detained by ICE despite his compliance with every condition and rule ICE imposed on him. Despite following the rules and becoming a valued member of his community, Mr. Alvarado Carrero was transferred in chains through various ICE detention centers across the country, including the infamous "Alligator Alcatraz," where he was chained to a bed for 17-hours straight. Mr. Alvarado Carrero had been detained in central California, thousands of miles away from his family and friends in Florida.
Trial Impact Project Reunites Venezuelan Asylum Seeker with His Family in Florida After He Was Unlawfully Re-Detained by ICE
Trial Impact Project has secured the release of Mariano Alvarado Carrero, a Venezuelan asylum seeker, from ICE detention at Golden State Annex (GSA) in McFarland, California. Mr. Alvarado Carrero is now reunited with his family in Miami, Florida. After learning of Mr. Alvarado Carrero’s case from the California Collaborative for Immigrant Justice (CCIJ), Trial Impact Project attorneys filed a Petition for Writ of Habeas Corpous on behalf of Mr. Alvarado Carrero. The habeas petition asserted that ICE violated Mr. Alvarado Carrero’s Fifth Amendment right to due process when it re-detained him without any notice or opportunity to challenge the detention. Eighteen-days later, a federal judge agreed and ordered Mr. Alvarado Carrero’s immediate release. In the last year alone, over 40,000 immigrants like Mr. Alvarado Carrero have filed habeas petitions—more than under the last three administrations combined.
